Overland Park, KS – Senate candidate Jason Anderson has announced his opposition to Senate Bill No. 509 (SB 509), a proposed legislation offering refundable tax credits to families opting for private or homeschooling over public education. Anderson criticizes the bill for diverting essential funds from public schools and unfairly benefiting affluent families at the expense of community-wide educational equity.

"SB 509 threatens the foundation of public education in Kansas by redirecting taxpayer dollars to private interests," Anderson stated. He urges Kansas senators to reject the bill, emphasizing the importance of investing in public schools that serve all children.

Position: Opposition Testimony

Dear Senator,

I am writing as a concerned citizen and taxpayer of Kansas to express my strong opposition to Senate Bill 509, which was recently amended and passed out by the Senate Tax Committee. This bill proposes a per-child refundable tax credit for families choosing private or home schooling over public education. While the intent behind promoting educational choice is understood, the approach taken by SB 509 is deeply flawed and poses a significant threat to our public education system, which is a foundational pillar of our community.

The principle of public education is grounded in the belief that it serves as a universal good, akin to other public services such as parks, libraries, and emergency services. Just as individuals do not receive rebates for unused public services, providing a tax credit for non-participation in public education undermines the collective investment in a well-educated society. Public education is not merely a service but a civic commitment that ensures every child has access to quality education, irrespective of their background or financial standing.

Additionally, the bill’s $75 million cap, subject to automatic increases, represents a significant and deceptive fiscal burden. This move effectively shifts state funds towards subsidizing private education for students already outside the public education system, without any assurance of improved academic outcomes. It is important to highlight that this is not a cost-saving measure but an additional financial obligation that the state must bear, detracting from its capacity to invest in public schools.

Most concerning is the bill's provision for a refundable tax credit, allowing families to receive more from the state than their actual tax contribution. This creates a scenario where public funds are redistributed to support private education, regardless of a family's financial ability to support their educational choices independently. It is a misallocation of state resources, channeling taxpayer money away from public schools and into the hands of those who least need financial assistance, without any oversight or accountability for the expenditure.

SB 509 lacks any mechanism to ensure that the funds provided are used for legitimate educational expenses. This lack of oversight opens the door to potential misuse and fraud, as evidenced by similar programs in other states. It is imperative that state funds are managed responsibly and transparently, particularly when they are intended to support educational purposes.

I urge you to consider the long-term implications of SB 509 on our public education system and the principles of equity and accountability that it undermines. Investing in public education is an investment in the future of our state and its children. I strongly recommend that you oppose this bill and instead focus on measures that strengthen public education, ensuring it remains accessible and equitable for all.
